Agreement
These Terms of Use govern your use of the DinkHQ website, web app, racks and paddles (the "Services"). By creating an account or borrowing equipment you agree to these terms and our privacy policy. If you do not agree, please do not use the Services.
Eligibility
You must be at least 16 to create an account. Players under 16 may use borrowed equipment only under the direct supervision of a parent or guardian who holds the account and accepts these terms on their behalf.
Borrowing equipment
- Equipment is loaned free of charge for a single session, typically up to two hours, at the rack shown in the app.
- Equipment must stay at the host facility and be returned to the same rack before your session ends.
- One item per account at a time, unless the app says otherwise.
- We may limit, suspend or end access for late returns, misuse or breach of these terms.
Care, loss and damage
Please use equipment only for its intended sport and report any damage when you return it. Normal wear is expected and never charged. If equipment is not returned or is deliberately damaged, we may suspend your account and, where permitted by law, ask you to cover the reasonable replacement cost.
Player conduct
- Follow the rules and posted policies of the host facility.
- Do not tamper with racks, locks, QR codes or the app.
- Do not share sign-in codes or borrow on behalf of someone else without supervising them.
- Be respectful to staff and other players.
Assumption of risk
Racquet sports involve physical activity and a risk of injury. You are responsible for checking equipment before use, playing within your ability and following our safety guidelines. Equipment is provided as is. To the extent permitted by law, you participate at your own risk.
Limitation of liability
To the extent permitted by law, DinkHQ, its operator, sponsors and host facilities are not liable for indirect or consequential losses arising from use of the Services. Nothing in these terms limits liability that cannot be limited under Ontario law, including for negligence causing personal injury where such limits are prohibited.
Sponsors and offers
Sponsor logos and partner offers are provided for your information. Using the Services does not require you to buy anything or meet with any sponsor. Offers from partner shops are governed by that shop's own terms.
Content and intellectual property
The DinkHQ name, logo, app and site content belong to us or our licensors. You may not copy or reuse them without permission. Feedback you submit may be used to improve the program in aggregate form.
Governing law and changes
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. We may update these terms and will post the new date above. Continued use after changes means you accept them. Questions go to hello@dinkhq.com.
